Version 2.0 — Effective 14 July 2026. This version supersedes the 2025 Terms and updates our Storage Policy, adds an Abandoned Property section, and clarifies membership renewal.

By registering for, or using, services provided by TradeWinds Logistics and Transport Inc. (“TradeWinds L&T,” “TradeWinds,” “we,” “our,” or “us”), you agree to these Terms and Conditions. They govern your use of our services and set out your rights and responsibilities as a customer.

1. Acceptance of Terms

You accept these Terms when you register for an account, submit an invoice or shipment through our portal, or use any TradeWinds service. Where you are asked to tick a box confirming acceptance, we record the date and the version of the Terms you accepted. We may update these Terms from time to time; the current version is always published on this page and the effective date is shown above. Continued use of our services after an update constitutes acceptance of the updated Terms.

2. Services Provided

TradeWinds L&T is a freight forwarding company specialising in the receiving, consolidation, and shipping of packages from Miami to the Cayman Islands. We also provide: domestic U.S. forwarding; package retrieval and collection; receipt and redirection to another shipping provider; delivery to hotels, airports, or customer accommodations; personal and in-store shopping; and warehousing and drop-shipping solutions for businesses. Packages may be delivered to our Florida warehouse by USPS, FedEx, UPS, DHL, other couriers, or in person.

3. Membership

You must be 18 years or older to register. There is no fee for standard (Gold) membership. Platinum membership is optional, costs CI$175 per year, and includes additional benefits including a members-only air freight rate and extended free storage. Platinum membership does not auto-charge; we invoice you before your term expires, and membership lapses to Gold if unpaid. By registering, you agree to receive emails and text messages about your shipments, invoices, and service updates.

4. Cayman Customs Authorisation

Customers importing goods into the Cayman Islands must register with Cayman Islands Customs and Border Control (CBC), assign TradeWinds L&T as their authorised agent, and consent to TradeWinds L&T handling the clearing and processing of goods on their behalf.

5. Prohibited & Restricted Items

Certain goods are prohibited by U.S. Customs & Border Protection (CBP), the Federal Aviation Administration (FAA), Cayman Islands Customs, and our cargo carriers. These include, but are not limited to, weapons, flammables, illegal substances, and unlicensed medications. Illegal substances found in your package will be reported to CBP and Cayman Customs and confiscated. No reimbursement will be provided for confiscated items. Some HAZMAT items can be shipped with FAA approval and special documentation; special handling fees will be billed to you.

6. Shipment & Invoice Requirements

All packages must be accompanied by a valid invoice showing item description, store or seller name, subtotal, shipping, tax, and total. Invoices should be submitted through your customer portal as soon as you place the order — not after the package arrives. If no invoice is provided, you must pre-alert your shipment with an accurate tracking number and complete item details and cost. Missing or incomplete information may delay shipping and customs clearance.

7. Business vs Personal Imports

Goods for personal use are cleared as non-commercial. Business imports may qualify for reduced duty rates with a valid Trade & Business licence submitted to TradeWinds in advance.

8. Payments, Invoices & Wallet Credits

Invoices are issued when your shipment is submitted to Cayman Customs, via QuickBooks or our online portal. Payment is required before delivery or distribution. We accept Visa/MasterCard (ID required) and cash (KYD & USD). Cheques are not accepted. Refunds are issued as wallet credits, which may be used against future shipments and do not expire.

Prices are quoted in Cayman Islands dollars (CI$). Where a U.S. dollar figure is shown, it is converted at CI$1.00 = US$1.22 for convenience; the billing currency shown on your invoice governs.

9. Storage Policy

Storage is charged per package, per day, once the applicable free period has ended.

U.S. (Miami) Warehouse — the free period runs from the date we receive your package at our Florida warehouse.

Peak season (1 November – 31 December). During peak season, free storage periods are halved: Miami — Gold 7 days, Platinum 15 days; Cayman — Gold 3 days, Platinum 7 days. The daily rate is unchanged.

Storage charges accrue daily, including weekends and public holidays, and are added to your outstanding balance. Packages will not be released until all charges, including storage, are paid in full.

10. Abandoned Property

If a package remains uncollected, storage charges continue to accrue and we will notify you as follows:

  • When free storage ends — notice that storage charges have begun.
  • At 45 days — reminder, showing charges accrued to date.
  • At 75 days — final notice, stating the date the package will be deemed abandoned.

A package uncollected 90 days after the free storage period begins is deemed abandoned. Once a package is abandoned, TradeWinds may sell, donate, or dispose of the goods without further notice, and apply any proceeds against amounts you owe us, including storage, freight, handling, customs duty, and any duty advanced on your behalf. You remain liable for any shortfall. Where proceeds exceed the amount owed, the surplus is available to you on written request for 6 months from the date of disposal.

Notices are sent to the email address on your account. It is your responsibility to keep your contact details current.

11. Concierge & Additional Services

Package collection and retrieval, hold-and-deliver, delivery to a hotel, airport, or another shipping provider, personal and in-store shopping, and returns handling are charged according to our published Service Fee Schedule. These charges are billed in addition to standard freight, handling, customs, and any storage charges. Fees are quoted before work begins wherever practicable.

12. Cayman Duty & CIF

Customs duty is calculated on the CIF value — the cost of the goods, plus shipping, plus insurance (1% of item and shipping cost). Duties typically range from 22% to 27%, with 22% being most common. Duty is a pass-through charge set by Cayman Customs, not by TradeWinds. We charge a customs handling fee of CI$10 or 3% of any duty we advance on your behalf, whichever is greater.

13. Limitations of Liability

TradeWinds L&T is not responsible for: packages not yet received at our Miami warehouse; damage due to insufficient packaging; packages left outside without signature; incorrect information submitted by customers (including value, address, or contents); delays beyond our control (weather, strikes, carrier disruption, acts of terrorism, and similar); customs duty amounts imposed by CBC; consequential losses (including business losses and missed opportunities); errors by third-party affiliates; and uninsured goods (televisions and electronics are shipped at the customer’s risk).

14. Credit & Refund Policy

TradeWinds does not issue cash refunds except in specific cases; instead, wallet credits are applied for overpayments, TradeWinds-confirmed billing errors, service disruptions caused by TradeWinds, and approved insurance claims. For damaged goods, report the damage within 2 days of the distribution notice; a claim will be submitted to the insurance provider. TradeWinds is not responsible for delays in, or the outcome of, insurance claims, which typically take 30 days or more.

15. Account Sharing

Only the Primary Account Holder is responsible for all charges and shipments, even where multiple users share an account.

16. Suspension

Unpaid balances may result in temporary suspension of service until paid in full.

17. Keeping Your Details Current

You are responsible for keeping your delivery address, phone number, and email current in your customer portal. We may ask you to confirm your details periodically. Where a delivery fails because the address on your account is incorrect or out of date, a re-delivery fee of CI$25 applies.

18. Privacy

We collect only the data necessary to fulfil services and to comply with customs and legal obligations. Your data may be shared with carriers and logistics partners, customs and regulatory agencies, and payment processors (QuickBooks, PayPal). We do not sell your information. All personal data is protected under reasonable security standards.
